Repeat and Serious Violations

OSHA initiated an investigation of a fire and smoke damper manufacturer as a follow-up to a comprehensive inspection conducted in 2005. As a result of that investigation, the company was cited for five willful and four repeat violations, plus one serious violation carrying proposed penalties totaling $140,760. The willful violations allege failure to provide elements of a hearing conservation program, including audiometric testing and training to employees exposed to noise levels above 85 decibels. The repeat violations allege failure to properly record employee injuries and illnesses, failure to guard the point of operation on rivet machines and an electrical hazard. The serious violation alleges the company’s failure to make the plant’s main exit accessible by a minimum width of 28 inches at all points.
